Michigan’s governor is appealing a federal decision to keep open an oil pipeline running between Lake Michigan and Lake Huron

The Line 5 pipeline carries crude oil and natural gas from Wisconsin through both Michigan peninsulas and into Canada.
 
The state has spent years trying to end the 1953 deal that allowed for the pipeline, alleging breach of contract due to safety concerns.
 
Last month, however, a federal court ruled that U.S.-Canadian treaty policy and federal laws regarding pipeline safety supersede the state’s worries.
 
Now, Governor Gretchen Whitmer is appealing the decision.
 
This would be the second time the lawsuit to block the state from shutting down Line 5 appears before the U.S. Circuit of Appeals.
 
In April, the appellate court let the case continue after rejecting a constitutional challenge from the state.
 
A separate case against the pipeline is playing out in state court.
