Court of Claims judge strikes down MI abortion restrictions

Judge Sima Patel says the laws are unconstitutional violations of the voter-approved reproductive rights amendment to the state constitution

The lawsuit was filed by family planning clinics and an organization that represents medical students who favor abortion rights. Their goal is to clear up uncertainties regarding abortion laws dating back decades before the adoption of the Reproductive Freedom for All Amendment in 2022.

Judge Patel held that required 24-hour waiting periods, compulsory viewing of photos or renderings of fetuses and a ban on advanced practice clinicians performing abortions are not allowed under the amendment.

She upheld a law that requires screening patients to guard against coercion. Governor Gretchen Whitmer is cheering the ruling, saying it ensures patients and doctors are not subject to outdated restrictions.
