A Democratic state lawmaker has sponsored a proposal to strike the language of the dormant same-sex marriage ban from the Michigan Constitution.
It would take super-majority votes of the House and the Senate to put a question on the ballot asking voters to amend the state constitution. Michigan’s same-sex marriage ban is unenforceable under a 10-year-old U-S Supreme Court decision.
But Representative Jason Morgan says the fact that the U-S Supreme Court reversed abortion rights protections shows a willingness to revisit foundational rulings, including the one that allowed him to marry his partner.
“If the Supreme Court were to overturn this protection for marriage equality, it would become illegal again for any same-sex couple to get married in our state.”
A Democratic state senator has called for a petition campaign to put a question to amend the constitution on the ballot.
