The interpretation of Michigan campaign finance law says paying for childcare care expenses can be a necessary part of campaigning or holding office and so can be reimbursable costs.
The statement says that can be especially true for single parents.
The statement says the same principle applies to reimbursement for eldercare.
In both cases, the candidate or officeholder has to show the expense would not exist except for the fact that the person is running for or holding a political office.
It also says the department may seek proof that the candidate is a primary care provider.
The opinion was requested by eight state lawmakers who are also mothers of young children.
