Some Republican county prosecutors say it’s up to them to decide whether to charge abortion providers under the 1931 state law

An Oakland County judge says he’ll issue a ruling Friday on whether to extend a temporary order that shields abortion providers in Michigan from prosecution under a dormant state law.

Governor Gretchen Whitmer’s ultimate goal is a court decision that abortion rights are protected under the Michigan Constitution.

Chief Deputy Attorney General Christina Grossi said the governor has a responsibility to protect public health and safety, including the right to make medical decisions:

“We don’t have to protect women from themselves. Women are capable of making informed decisions.”

Some Republican county prosecutors say it’s up to them to decide whether to charge abortion providers under the 1931 state law. Their attorney argued Whitmer’s request is a power grab that should be denied.
