Ban on enforcing abortion law to be topic of court hearing

There’s a court hearing tomorrow on whether to lift a ban on enforcing Michigan’s 1931 abortion law.

Governor Gretchen Whitmer requested the restraining order to block county prosecutors from filing felony charges against abortion providers.

Whitmer argues abortion rights should be protected under a privacy clause in the Michigan Constitution.

Prosecutors in Kent and Jackson counties want the restraining order to be lifted.

They say it should be up to them to decide whether to file felony charges against abortion providers.

There’s also an opposition brief filed by other county prosecutors who support abortion rights, and they say there should be one statewide standard.

Governor Whitmer also filed a request for the Michigan Supreme Court to step in, bypass lower courts, and take over the case.
