Toronto-based clothing company Roots alleges Meijer is infringing on its trademark after Meijer applied for its own trademark on a new back-to-school line called “Roots & Threads.”
The United States Patent and Trademark Office rejected Meijer’s trademark application, citing the likelihood of customer confusion.
Roots filed a federal lawsuit against Walker-based Meijer on August 8 in Michigan’s Western District Court, complaining Meijer has continued with the launch despite receiving cease-and-desist letters.
Roots claims that its reputation may be damaged “when customers learn that the Roots & Threads Goods are not the same high-quality, long-lasting, and stylish children’s clothes offered by Roots.”
Roots has 108 stores across Canada and two in the U.S: in Birmingham, Michigan and Park City, Utah.
WGVU reached out to Meijer for comment, but a spokesperson has not yet responded.
