The hearing comes after the university decided to terminate Tucker’s contract following allegations of sexual harassment from rape survivor and activist Brenda Tracy.

Mel Tucker’s legal team sent a letter this morning to MSU interim president Teresa K. Woodruff and the board of trustees.

The letter says quote “Under the Office of Institutional Equity rules, we are prohibited from participating in the hearing scheduled for October 5th and 6th because Mr. Tucker is not available due to a serious medical condition.”

The 106 page document also outlines quote “new evidence that undermines MSU’s decision to terminate Mr. Tucker” - end quote. Among that evidence is newly revealed text messages, allegedly from Tracy to a close friend.

Lansing-area attorney Elizabeth Abdnour, who specializes in Title IX, says the hearing will still take place, whether or not Tucker is in attendance. She says the resolution officer will move forward with considering everything in the report and all evidence submitted by both parties.
