Prosecutors in Michigan are lining up on different sides of an argument about whether the state’s 1931 sweeping ban on abortion services is enforceable.
That law is currently on hold, but a recent Court of Appeals ruling could open the door to prosecution of abortion providers in some counties where clinics are located. And some prosecutors have said they’re ready to file charges against abortion providers.
But Oakland County Prosecutor Karen McDonald says the question should not be left to the discretion of each county prosecutor.
“This makes no sense. We should keep it the status quo until the voters weigh in or the Michigan Supreme Court weighs in.”
McDonald and six other prosecutors have filed a brief with the Supreme Court. A petition campaign is seeking to place an abortion rights amendment in the state constitution.
