The Michigan Supreme Court sided with the state Attorney General Friday in a case against drug-maker Eli Lilly. The court overturned years of precedent along the way.
The AG wants to investigate insulin pricing under the “Michigan Consumer Protection Act.”
But the law has an exception for licensed business overseen by government regulators.
Past rulings broadly interpreted that exception to apply to authorized business generally, even when a business has allegedly acted in a specific way that isn’t allowed.
Now a 4-3 split Michigan Supreme Court overturned that precedent.
Michigan Attorney General Dana Nessel says that’s major.
“Today’s decision sets the foundation for a fair marketplace.”
Dissenting justices ruled an allegation of misconduct should’ve been made before the case came before the court.
