Michigan’s laws around election recounts could be in for some big changes

The bills aim to improve the recount process through changes like tightening requirements to avoid frivolous recounts.

But Republican Representative Rachelle Smit is taking issue with the removal of language that currently allows candidates to request a recount because of suspected fraud.

“It’s not a crime, or at least it shouldn’t be, to practice skepticism.”

Democratic Representative Penelope Tsernoglou says elections boards shouldn’t be investigating fraud anyway.

“The right to investigate and potentially prosecute violations of the law is clearly and unequivocally the job of law enforcement and our prosecutors.”

The package would still allow recounts for good faith beliefs that an error changed the election outcome.
