Former President Donald Trump

The Michigan Court of Appeals has ruled former President Donald Trump can stay on the state’s presidential primary ballot.

Trump had been at the center of a lawsuit against the Michigan Secretary of State to remove the former president’s name from the ballot.

The complaint argued that Trump had incited the January 6th 20-21 insurrection at the U-S Capitol.

And that by doing so—Trump was disqualified from becoming president under the “insurrection clause” in the U-S Constitution’s 14th Amendment.

The lower court ruled against the plaintiffs in the case.

Now the Court of Claims is joining in. It punted on whether Trump is disqualified from the presidency.

But the appellate court ruled the Secretary of State doesn’t have the authority to decide presidential primary candidates—political parties do.
