A judge has granted Governor Gretchen Whitmer’s request for a court order to block enforcement of Michigan’s felony abortion ban. That’s after a Michigan Court of Appeals decision appeared to clear a path for prosecutions under a 1931 law.
A day-long flurry of court actions centered on the status of abortion rights in Michigan. Governor Whitmer’s request was among them. And Planned Parenthood attorney Deborah LaBelle says the court order means abortion remains legal in the state.
“This temporary restraining order says, no, the status quo is continuing.”
David Kallman represents county prosecutors who say it’s up to them to decide to decide whether to file charges for violations of the 1931 law. He says there’s a Wednesday hearing.
“But it’s obvious this is going to have to go to a higher court.”
Whitmer also wants the Michigan Supreme Court to take up the question of whether abortion rights are protected under the state constitution.
