MI Supreme Court to hear COVID refund tuition case

This will be one the first cases the Supreme Court will hear during the new session that begins this month. A group of families sued Central Michigan University, Eastern Michigan University and Lake Superior State University for switching to virtual classes that students took from home. They’re seeking reimbursement of tuition, room and board and student fees.
They say cancelling in-person classes and closing campus housing amounted to violating a contract. The universities argue the COVID pandemic was an unforeseeable circumstance which, under the student-school agreement, does not require refunds. A split panel of the Michigan Court of Appeals agreed with the universities in a split decision last year.
