Court orders related to this case and others ensured abortion remained legal in Michigan in the months following the US Supreme Court’s Dobbs decision and in the runup to the 2022 election. That’s when voters approved a reproductive rights amendment to the state constitution that effectively quashed the law.
The Legislature’s new Democratic majorities have also vowed to formally repeal the dormant 1931 law.
With the amendment on the books, Whitmer asked the court to dismiss the case in a filing two weeks ago.
The court agreed that the amendment settles the question and declared there is no longer a controversy for the court to resolve.
