Governor Gretchen Whitmer and Democratic prosecutors are asking the Michigan Supreme Court to step in and immediately take up the question of whether the state constitution protects abortion rights.

The governor renewed a request made before Roe v Wade was struck down in a decision that left abortion as an issue for states to decide.

“The Michigan Supreme Court should hear that case now.”

Washtenaw County Prosecutor Eli Savit says abortion rights in Michigan are protected at the moment by a state Court of Claims order.

“Litigation is going to continue. There’s no question about that and, to be candid, that injunction like any injunction could be lifted by a higher court. It could be lifted by the judge,” said Savit.

Savit says that’s why it’s important for the Michigan Supreme Court to step in and settle the question once and for all.
