The head of the Michigan State Police says criminal charges may be part of the department’s response to what appears to be falsified results of field breathalyzer tests.
State Police Colonel Joe Gaspar testified before the state Senate Judiciary Committee – which is looking into the results of an audit that found some breathalyzer results were falsified by lab technicians.
Gaspar says it’s impossible to tell how many convictions could be affected.
“Every drunk driving case presents a unique set of facts, making difficult to say more drunk driving convictions, or even pleas, are now in question.”
A defense attorney who testified said part of the solution should be removing analysis of breathalyzer results from the purview of the state police – and that’s because the agency and its officers have a stake in the results.
